Staff Attorney Positions—Office of the Attorney General

The Child Support Services Division (CSSD) of the Office of the Attorney General for the District of Columbia is seeking an Attorney-Advisor for the Policy & Training Section. CSSD administers the District's child support services program that includes locating non-custodial parents, establishing legal paternity, establishing support orders, enforcing legal support obligations including medical support, and modifying support orders. The Division is also responsible for the State Disbursement Unit that processes all child support payment collections and disbursements.
The Policy & Training Section is responsible for creating comprehensive policies and procedures to support the daily operations of the child support program, providing advice on agency policy and program matters, and implementing a professional development and training program. The Attorney-Advisor will work under the supervision of the Section Chief for Policy & Training and with the CSSD Deputy Attorney General on high level policy matters for the Division.
The successful candidate must be a member of the District of Columbia Bar or eligible for waiver into the bar. The candidate must also have excellent oral and written communication skills, outstanding legal research skills, prior experience providing training, and facility with and/or knowledge of automated case management systems. Prior policy-writing experience and knowledge of the federal and local laws and regulations governing the District’s child support programs is highly desirable.

The Civil Litigation Division of the Office of the Attorney General for the District of Columbia is seeking two trial attorneys for its General Litigation section. General Litigation is responsible for defending the District of Columbia in civil lawsuits in which plaintiff seeks money damages and/or individual injunctive relief. The General Litigation sections defend cases in both DC Superior Court and the US District Court for the District of Columbia. The cases primarily are in the areas of government contract, personal injury (slip and fall, automobile, police false arrest/assault, medical malpractice and inmate assaults), federal constitutional civil rights claims (First Amendment claims regarding freedom of religion, the right to demonstrate and protest in public areas, whistle blower claims) and employment discrimination.
The Attorney’s primary responsibility for this position will include defending the District of Columbia before the DC Contract Appeals Board relating to breach of contract claims filed by contractors. The successful candidate for this position should have at least 3 years of experience in government contract litigation, preferably in the area of breach of contract claims. In addition, the candidate should be knowledgeable of the DC Procurement Practices Act (PPA) and/or the Federal Acquisition Regulations (FAR). The successful candidate must also have a law degree, excellent research and writing skills, experience in conducting discovery and prior trial experience.

The Civil Litigation Division, Consumer and Trade Protection Section, Office of the Attorney General for the District of Columbia is seeking a trial attorney to handle consumer protection matters. This attorney will work on civil enforcement of the District’s Consumer Protection Procedures Act and related federal consumer protection laws. Much of the work will focus on “local” issues pertaining particularly to D.C. consumers or to businesses based in D.C. Other enforcement work will involve participation in multi-state groups of assistant attorney generals that investigate, litigate, or resolve consumer protection issues on a national scale. Duties will include: conducting pre-complaint discovery using compulsory process and informal methods, analyzing factual and legal issues, preparing matters for litigation, litigating cases through trial, coordinating efforts with other District, state, and federal enforcement agencies, and preparing and reviewing amicus filings, multi-state attorney general statements, legislative proposals, and consumer education materials.
The successful candidate must have a law degree and be a member of the District of Columbia Bar or be eligible for waiver into the bar. If a candidate is selected and is not a member of the District of Columbia Bar, he/she must apply for membership and show proof of such prior to the commencement of employment. The candidate must have prior civil litigation experience and excellent analytical and legal writing skills. Prior consumer protection work is desirable but not required.
The position is within the Collective Bargaining Unit. It is a 13-month term appointment, funded by the District of Columbia Consumer Protection Fund (D.C. Code § 28-3911). Renewal of the 13-month term depends on satisfactory performance and continued availability of funding.

The Office of the Attorney General for the District of Columbia (OAG) is seeking candidates for the position of Assistant Attorney General in the Office of the General Counsel (OGC) for the Department of Consumer and Regulatory Affairs (DCRA). DCRA protects the health, safety, economic interests, and quality of life of residents, businesses, and visitors in the District of Columbia by issuing licenses and permits, conducting inspections, enforcing building, housing, and safety codes, regulating land use and development, and providing consumer education and advocacy services. DCRA takes legal action against businesses and individuals who violate District laws, and works to prevent the occurrence of illegal, deceptive, and unfair trade practices through education and public awareness programs.
In furtherance of DCRA’s mission, the Office of the General Counsel (1) provides legal advice and support to the agency’s senior management team on a broad range of matters; (2) represents DCRA in administrative hearings before the Office of Administrative Hearings and the Board of Zoning Adjustment; (3) participates in development of legislation and rules for the agency; and (4) assists in drafting memoranda of understanding with other District agencies.
The candidate must have a working knowledge of the operations of the District government, effective interpersonal skills, strong legal research and writing skills, and effective oral and written communication skills and litigation skills. Knowledge of relevant federal and District public laws including the District’s Construction, Housing and Zoning Codes, the Nuisance Abatement Reform Amendment Act of 2006, the General License Law, the Business Corporation Act and the Department of Consumer and Regulatory Affairs Civil Infractions Act of 1985 is highly desirable. Specific experience in legislative drafting and rulemaking is also desirable

The Office of the Attorney General is seeking an Attorney-Advisor for the Office of the General Counsel in the DC Department of Human Resources (DCHR). DCHR administers the human resource management program for subordinate agencies to ensure that the District government attracts, develops and retains a well-qualified, diverse workforce in compliance with the Comprehensive Merit Personnel Act and other relevant District and federal laws, rules, and regulations. The Office of the General Counsel provides legal advice to the Director, DCHR, and agency management on a variety of complex legal issues in order to effectuate DCHR’S mission. The Office of General Counsel provides legal advice and guidance to both subordinate and independent agencies within the District government regarding matters involving personnel and employment law.
Specific responsibilities of the Attorney-Advisor will include but shall not be limited to: Serving as attorney to the Police and Firefighters Retirement and Relief Board (Board), an adjudication board under DCHR responsible for determining eligibility for retirement, disability and related matters for District police and firefighters, US Park Police and US Secret Service and their survivors; Representing the Board at hearings and writes recommended decisions determining eligibility for retirement and/or disability benefits; Providing expert legal advice in the area of retirement and disability benefits to the Board, attorneys, and doctors on the Police and Firefighter’s Retirement and Disability Act and other related District and federal employment-related laws; Serving as Litigation Coordinator for the Board on appeals of Board decisions to the DC Court of Appeals; Assisting the General Counsel for DCHR in providing legal advice to the Director, DCHR, as well as carrying out other legal tasks that may be required for DCHR, and assisting OAG and Office of Labor Relations and Collective Bargaining in preparing cases for litigation before courts and administrative tribunals; Reviewing and analyzing, for legal soundness and accuracy, various documents including legislation, regulations, memoranda of agreement, FOIA responses, and proposed notices for corrective and adverse actions; Drafting legislation and rulemaking related to DCHR mission and functions; and Keeping abreast of legal, administrative and other changes and interpretations regarding laws and regulations related to the functions of DCHR.

The Office of the Attorney General of the District of Columbia is looking for two Attorney-Advisors to work in the Office of the General Counsel for the Department of Transportation.
The Department of Transportation (DDOT) provides municipal services in three distinct program areas: transportation infrastructure, transportation policy, and public space management. Each contribute to making District streets and public spaces effective means of transporting people, goods, and information efficiently and safely, with minimal adverse impacts on residents and the environment.
The successful candidates for this position will provide legal guidance on policy, legislative, administrative and personnel matters. The attorney will represent DDOT in adjudicatory and quasi-adjudicatory proceedings including representing the Department before the Office of Administrative Hearings, which conducts administrative hearings on appeals of unemployment compensation and notices of violations of the laws, rules, or regulations set forth in D.C. Law 6-100, the Litter Control Administration Act of 1985, effective March 25, 1986. The successful candidate will be responsible for preparing pretrial discovery, writing motions, preparing briefs, and conducting direct and cross-examination of witnesses. The successful candidate will provide legal support to OAG on matters before the Office of Employee Appeals where agency disciplinary actions are appealed. In addition, the successful candidate will represent the agency before the DC Office on Human Rights and the Equal Employment Opportunity Commission on mediations and fact-finding sessions; and responding to complaints of discrimination.
The successful candidate will conduct legal sufficiency reviews of transportation safety grants awarded to the District by the National Highway Transportation Safety Administration (NHTSA), and provide legal advice on the allowable uses of NHTSA grants. The successful candidate will also conduct legal sufficiency reviews of MOAs and MOUs; draft legislation; conduct legal research and writing; and prepare legal advice memoranda. Experience in complex real estate transactions and acquisitions is highly desirable but not required (e.g., transactional experience with title work, deed, easement, lease, purchase and sale preparations, real estate closings, or related matters; real estate acquisition by eminent domain or quiet title).

District of Columbia Public Schools: Attorney-Advisor
This position is located in the Office of the General Counsel (OGC), DC Public Schools (DCPS) serving as an Attorney-Advisor in providing legal guidance and rendering opinions for DCPS in the area of special education by facilitating legal compliance with the requirements of the Individuals with Disabilities Education Improvement Act of 2004 (IDEIA). This office helps ensure that DCPS meets the needs of their students in a fair and consistent nature.
The candidate must have knowledge and ability to provide a full range of legal advice and litigation services related to special education and the IDEIA; Knowledge and ability to serve as an Attorney-Advisor on highly complex legal issues, making substantive, programic, and administrative recommendations, and ability to make effective oral presentations in a clear and concise manner and demonstrated skill in preparing well-written, organized and persuasive legal documents.
The successful candidate must be a member of the District of Columbia Bar or eligible for waiver into the bar; also have excellent oral and written communication skills; and must have at least one year of experience in handling labor relations matters; the successful candidate must have a high level of technical legal knowledge of the full range of applicable DCPS, District of Columbia, and federal legal statues, codes and procedures in order to provide legal and quasi-legal services to the General Counsel, supervisor, DCPS administrative staff, and the Chancellor. The successful candidate must have a high level of familiarity with the Title 31 of the District of Columbia Code and DC Court Rules, Chapter 30 of the District of Columbia Municipal Regulations (DCMR), IDEIA, the Federal Educational Records and Privacy Act (FERPA), Section 504 of the Vocational Rehabilitation Act of 1973, the American’s With Disabilities Act of 1990 (ADA), the Elementary and Secondary Education Act of 1965(ESEA) (20 USC 6300 et. seq.), the No Child Left Behind Act of 2001, and the Freedom of Information Act.

District of Columbia Public Schools: Attorney-Advisor
The District of Columbia Office of the Attorney General (OAG), Office of the General Counsel for the District of Columbia Public Schools (Agency) seeks an Attorney Advisor to join its team. The successful candidate will serve under the direct supervision of the Supervisory Attorney Advisor for Labor and Employment and the General Counsel. The incumbent will provide legal advice to management in all employment-related matters, including labor arbitration and compliance with Title VII, ADEA, ADA, and other federal, state and local laws regulating employment before administrative tribunals. Particularly, the successful candidate will represent the Agency before the District of Columbia Office of Employee Appeals on personnel actions such as adverse actions for cause that result in removal, reduction in grade, or suspension for 10 days or more; Reductions-in-force (RIF); performance ratings which result in the removal of the employee; and placement of employee on enforced leave that lasts 10 days or more.

The successful candidate must have excellent oral and written communication skills and a strong desire to learn the area of labor relations, and policies, procedures, and practices of the Office of the General Counsel. The Office of the Attorney General for the District of Columbia is seeking a Trial Attorney for a position within the Family Services Division, Child Protection Section.
Attorneys in the Child Protection Sections represent the Child and Family Services Agency (CFSA) in the approximately 2500 open child abuse and neglect cases in the Family Court of the DC Superior Court. There are four Child Protection Sections. One of these sections specializes in litigating termination of parental rights (TPR) cases and providing assistance in adoption matters when necessary. Attorneys in the other three sections handle all other aspects of child neglect litigation on behalf of the District and CFSA including petitioning new cases alleging child abuse or neglect, propounding and/ort responding to discovery, filing and/or responding to pre-trial motions, participating in mediation, preparing witnesses to testify at trial, and presenting evidence at trial. The attorneys’ representation continues post-adjudication with the goal of ultimately securing a safe and permanent home for children through reunification, adoption or guardianship. In the post-adjudication phase of a neglect case, attorneys are responsible for representing CFSA at regular permanency and review hearings, participating in occasional evidentiary hearings, filing motions and responsive pleadings, advising and counseling social workers and other professionals from CFSA, participating in clinical staffing and administrative reviews, and working with various multi-disciplinary team members. Attorneys maintain a relatively small trial caseload and a larger post-adjudication caseload. Attorneys are in court approximately 50 percent of their time.
The successful candidate must have a law degree and be a member of the District of Columbia Bar or eligible for waiver into the bar. The candidate should also have a demonstrated commitment to work in the area of child protection or family law issues. Litigation experience is preferred, but not required. The positions are at the LS-11 to LS-13 level, depending on experience.

The Public Safety Division of the Office of the Attorney General for the District of Columbia is seeking 2 Trial attorneys for the Juvenile Section. The Juvenile Section handles all juvenile prosecutions in the District of Columbia. The Section has jurisdiction to charge any criminal offense under the D.C. Code, Federal Code, or D.C. Municipal Regulations. The duties of the trial attorneys in the Juvenile Section include interviewing and preparing police and civilian witnesses; making charging decisions; researching, writing, and litigating motions; managing all aspects of a trial calendar from intake through sentencing.
The successful candidate must have a law degree and must either be a member of or eligible for waiver into the District of Columbia Bar.
